O pagamento, segundo o MP, tinha como objetivo manter um contrato da empresa com a Prefeitura de Castro.<\/p>\n<p>Um v\u00eddeo j\u00e1 havia flagrado o momento em que Fadel recebia o dinheiro da empresa, refor\u00e7ando as investiga\u00e7\u00f5es que se arrastavam h\u00e1 mais de uma d\u00e9cada. O caso ocorreu em meados de 2009, no segundo mandato dele como prefeito.<\/p>\n<p>Pelo acordo, homologado em junho deste ano, o deputado ter\u00e1 de pagar R$ 180 mil de multa, que ser\u00e1 revertida a uma entidade social. Em contrapartida, o processo ser\u00e1 encerrado e ele n\u00e3o ser\u00e1 julgado, condenado ou punido criminalmente.<\/p>\n<p>Segundo o Minist\u00e9rio P\u00fablico, o benef\u00edcio foi poss\u00edvel porque a pena prevista para o crime \u00e9 inferior a quatro anos e n\u00e3o envolve viol\u00eancia, amea\u00e7a ou crime hediondo. O MP ainda explicou que a medida foi aplicada em raz\u00e3o de decis\u00e3o do Supremo Tribunal Federal (STF), em setembro de 2024, que obrigou a an\u00e1lise da possibilidade do acordo tamb\u00e9m em casos j\u00e1 em grau de recurso.<\/p>\n<p>Em nota, Moacyr Fadel afirmou:<\/p>\n<p>\u201cO Acordo de N\u00e3o Persecu\u00e7\u00e3o Penal trata-se de uma solu\u00e7\u00e3o legal e conferida a qualquer pessoa. A assinatura teve como objetivo encerrar definitivamente uma a\u00e7\u00e3o judicial que se arrastava h\u00e1 mais de uma d\u00e9cada.
