De acordo com a den\u00fancia, os fatos teriam ocorrido entre os dias 3 e 4 de maio de 2025.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ap\u00f3s a fase de instru\u00e7\u00e3o processual, na qual foram analisados depoimentos, elementos de investiga\u00e7\u00e3o e outras provas apresentadas pelas partes, a ju\u00edza respons\u00e1vel pelo caso concluiu que n\u00e3o havia provas suficientes para sustentar uma condena\u00e7\u00e3o criminal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Na decis\u00e3o, a magistrada aplicou o princ\u00edpio jur\u00eddico do<a href=\"https:\/\/www.tjdft.jus.br\/institucional\/imprensa\/campanhas-e-produtos\/direito-facil\/edicao-semanal\/201cin-dubio-pro-reo201d\"> in dubio pro reo<\/a>, que determina que, em caso de d\u00favida, a decis\u00e3o deve favorecer o acusado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A defesa dos r\u00e9us foi realizada pela advogada Kelly Cristina Bida da Costa, que afirmou que a senten\u00e7a reconheceu a aus\u00eancia de provas necess\u00e1rias para a condena\u00e7\u00e3o. <\/span><span style=\"font-weight: 400;\">\u201cA ju\u00edza entendeu que n\u00e3o havia elementos suficientes para condenar os acusados. A senten\u00e7a analisou as provas apresentadas no processo e concluiu que n\u00e3o havia base para uma condena\u00e7\u00e3o criminal\u201d, afirmou.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A advogada tamb\u00e9m ressaltou que a decis\u00e3o foi tomada em primeira inst\u00e2ncia e que o processo ainda pode ser analisado por tribunais superiores caso haja recurso.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Conforme a legisla\u00e7\u00e3o brasileira, o crime de estupro de vulner\u00e1vel \u00e9 classificado como hediondo e prev\u00ea penas severas em caso de condena\u00e7\u00e3o. No entanto, a legisla\u00e7\u00e3o tamb\u00e9m estabelece que a responsabiliza\u00e7\u00e3o criminal s\u00f3 pode ocorrer quando h\u00e1 provas suficientes da autoria do crime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A decis\u00e3o ainda n\u00e3o \u00e9 definitiva e pode ser alvo de recurso por parte do Minist\u00e9rio P\u00fablico.
