O Supremo Tribunal Federal (STF) alcançou nesta segunda-feira (25) maioria de votos favoráveis à permanência de símbolos religiosos em órgãos públicos no Brasil. A decisão rejeita um recurso do Ministério Público Federal (MPF), que solicitava a proibição de crucifixos, imagens de santos e outros itens em prédios públicos.
O MPF argumentava que a presença desses símbolos fere os princípios da liberdade religiosa e da laicidade do Estado, previstos na Constituição. No entanto, o relator do caso, ministro Cristiano Zanin, sustentou que os elementos religiosos refletem a formação cultural e histórica do Brasil. “A presença de símbolos religiosos em prédios públicos, desde que tenha o objetivo de manifestar a tradição cultural da sociedade brasileira, não viola os princípios da não discriminação, da laicidade estatal e da impessoalidade”, escreveu Zanin.
Até o momento, o voto do relator foi acompanhado por cinco ministros: Flávio Dino, André Mendonça, Dias Toffoli, Gilmar Mendes e Edson Fachin. Zanin também destacou que práticas como feriados religiosos e nomes de localidades reforçam o vínculo cultural do país com o cristianismo, sem implicar inconstitucionalidade.
O julgamento ocorre em ambiente virtual e será concluído nesta terça-feira (26). O resultado definitivo consolidará a posição da Corte sobre o tema, mantendo a interpretação de que os símbolos religiosos podem coexistir com o Estado laico, desde que representem a cultura nacional.
