O presidente do Senado, Rodrigo Pacheco (PSD-MG), disse nesta quinta-feira, 5, que vê uma “maioria muito considerável” no Senado para aprovar propostas que limitam os poderes do Supremo Tribunal Federal (STF). As duas propostas citadas envolvem a fixação de mandatos para os ministros da Corte e a limitação nas decisões monocráticas dos magistrados.
“Vejo em relação a essas duas pautas uma maioria muito considerável do Senado, a favor de ambas”, disse.
Pacheco alegou que a discussão das propostas no Congresso não causa uma “crise” entre os dois Poderes da República. Segundo ele, tanto Judiciário quanto o Congresso têm autonomia para definir suas pautas.
“Não vejo nenhuma crise. Quando o STF define sua pauta de processos que tramitam e precisam ser decididos, não entendo como afronta ao Congresso, embora eventuais decisões possam ser invasão de competência, mas isso não é capaz de gerar uma crise que abale a harmonia entre os Poderes”, afirmou.
Questionado sobre se seria o momento de se discutir esse tipo de alteração na Suprema Corte, pouco tempo após os atos criminosos de 8 de janeiro, Pacheco foi mais contundente. Disse que, da mesma forma que o STF decidiu discutir temas como marco temporal, descriminalização das drogas e do aborto, o Congresso também tem autonomia para estabelecer sua pauta.
“A mesma conveniência do debate no STF sobre mandato de ministros, decisões monocráticas, fim da reeleição, crédito de carbono, regime fiscal, reforma tributária, é o mesmo momento em que o STF também compreendeu de tratar liberação de drogas, aborto, imposto sindical, marco temporal. Cada Poder tem a sua autonomia de decidir sua pauta. A pergunta que você me faz deve ser feita também ao STF”, respondeu Pacheco.
O Senado tem dado andamento nos últimos dias a propostas que causaram reação por parte da Suprema Corte. Primeiro, Pacheco reforçou sua defesa pública de fixação de mandatos de ministros do STF. Depois, a Comissão de Constituição e Justiça (CCJ) da Casa aprovou uma proposta que limita as decisões monocráticas (ou seja, individuais) do Supremo.
